Under the headline "State liability" the 9th Cologne Fine Art Insurance Talks will take place during the ART COLOGNE.
The term "State liability" first appeared in Sweden in 1974 in the context of art exhibitions. Since 1975, the USA have established a very detailed set of rules for granting state guarantees for exhibitions of international importance. In Germany, state and federal state guarantees have been increasingly issued since 1992. By now parliaments have approved the state guarantees in their public budget with an amount of EUR 6.95 billion, without any budget funds being available for them. For comparison, this amount exceeds the budget of the Federal Ministry of Food and Agriculture or the budgets of the federal states of Bremen or Saarland.
What is the legal basis for state and land guarantees? How is the question handled in other countries? Are sufficient funds immediately available in the event of a major loss? How are claims regulated? Could it possibly be an illegal aid in the sense of EU law? What are the possibilities for insurance companies? Are exhibition insurances really so incredibly expensive? What additional services can be expected from the private sector?
Peter Grabowski will discuss these and other questions about state and federal state liability with Carolin Scharpff-Striebich, art collector; Dr. Bodo Sartorius, for many years board member in companies that had art insurance as their focus; Dietmar Telschow of AXA XL, probably the largest art insurer in Europe; Lorenz Deutsch, the spokesman for cultural policy of the FDP in the North Rhine-Westphalian state parliament and Peter Raue, lawyer in Berlin.
